This week, General Motors (GM) CEO Mary Barra released the results of an independent investigation into the company's handling of its defective ignition switch recall. She said the report revealed a "pattern of incompetence and neglect" at the auto giant, but said there was no evidence of a cover-up of the problem. On May 16, GM was fined $35 million by the federal government for its mishandling of the recall related to the defective ignition switch. Evidence indicates GM engineers knew about the potentially deadly defect as early as 2001, but did not issue a recall until February of this year. Beasley Allen Founding Shareholder Jere L. Beasley told WAKA-TV8 he doesn't believe the automaker's top executives could have been ignorant of a problem that lingered for nearly 11 years. "We just simply do not believe that a company of this size, that the top people would not have known about something of this significance over a period of 11 years," Beasley says. He says he fears if there was incompetence to this degree, there may be other GM vehicles on the road with other defects that are currently unknown to the public.

Beasley Allen attorney Chris Glover visits the Beasley Allen Report this week to talk about the underlying causes of serious automobile accidents. More than 20 million automobile accidents occur each year in the United States. Chris shares information with show host and fellow Beasley Allen lawyer Gibson Vance about how design defects or mechanical problems can affect the outcome of a crash. Single-vehicle accidents, especially, can often be traced back to a defect that results in catastrophic injury or death. Specifically, Chris talks about a single-vehicle accident case he handled where attorneys discovered a defect in the design of a door that led to serious injury for the driver, a 16-year-old girl. Chris works in the firm's personal injury and products liability section. He says there are steps an automobile manufacturer can take to reasonably protect the occupants of a car in the event of a crash. This is called crashworthiness. In the case involving the 16-year-old girl, Chris says when attorneys looked at the car, which was involved in a rollover accident, they noticed the driver's side door was unusually damaged. They ultimately discovered the door opened during the crash. As a result, portions of the girl's body came out of the car during the crash, and she lost the use of her arm permanently. If the door had stayed closed, she would have been protected by the car's safety cage. Attorneys found that a defective design in the door caused pressure on the exterior of the door to free a latching rod inside the door, which allowed it to pop open.

The kite tube was made by Sportsstuff inc and it was basically a 10 foot wide circular inflatable watercraft that becomes airborne. People would try their best to stay on the kite tube 39 people were injured while operating this device, 29 of which needed hospitalization. Some of the injuries were quite severe, including: a broken neck, a punctured lung as well as facial injuries. Two of these people actually lost their lives. The suggestion statement on the product was featured next to crossbones and states:” never fly the kite higher than you are willing to fall.” Makes sense right? About 19,000 of these were recalled in 2006. 5. Samsung Galaxy Recalls Samsung recalled the Note 7 smartphones recently in 2016 after some of the batteries exploded or caught on fire! Samsung Note 7’s were being recalled from shelves in 10 countries including South Korea and the United States. People who bought the Note 7 could switch it out for something new but people were disappointed with the product failure. There were 35 confirmed instances of this new smartphone catching on fire and even exploding! It was estimated that 1 in every 14000 had faulty batteries but most likely, no one is going to want to take that risk unless it’s the new iphone. Most customer stated that the phone exploded while being charged. This goes to show, just the smallest errors in things like this can lead to dangerous products. This is mostly due to high powered lithium batteries, storing too much energy. Guys might want to consider not placing this phones in their pockets if they're planning on having kids someday. 4. Tommee Tippee Sippee Cups 3.1 Millions of these children's cups were recalled for a rather strange reason. The spill proof cups were becoming infested with mold spores in the removable, one-piece, white valve. Even when cleaned, moisture would remain in this area and some parents just wouldn’t clean this part. There were over 3,000 consumer reports of mold in the valves and 68 concerned parents reported illnesses from their children. The angry parents, posted photos on the Tommee Tippee Sippee Cups facebook page to show their disgust with the product. Consumers are advised to stop using cups with piece white valves. The company agreed to replace the cups, in an attempt to keep some of their customers. 3. Baby Milk Powder This doesn’t sound too appetizing. A huge scandal took place in China when an infant formula were containing a substance known as melamine was uncovered. This lead to an estimated 300,000 victims in total. Some children reportedly suffered from kidney stones and serious kidney damage with nearly 54,000 children being hospitalized. This lead to serious health concerns in china and a fear of exported goods from this country. Many countries refused to import goods from here, especially dairy products. The Chinese government prosecuted many people who were to blame executing two, placing 3 in prison for life and other serious punishments were administered. The substances placed in the milk were not well tested and over 2100 tons of powdered milk was destroyed and 9000 recalled. 2. Firestone and Goodyear Recall Possible one of the worst defaults by a tire company, firestone and Goodyear tires were exploding and shredding like no one had seen before. When ford motors found several models of 15-inch Firestone had severely high failure rate, this lead to the rightful closing of manufacturing plants. But the tires were still out there! Firestone ultimately demanded for a recall of over 2.8 million tires! This eventually led to 175 deaths and 700 injuries for firestone while much fewer were affected by goodyear tires. 1. Chinese Product Recall In 2007, China demanded a huge product recall and import bans were placed by the US, Canada, EU Australia and New Zealand when they began realizing certain products weren’t safe. Products shipped from China like pet food noticed that animals were falling ill and dying. It turns out it has the same chemical, melamine, that was placed in the baby milk powder. But this was just the tip of the iceberg. Marvel toys, recalled 175,000 dolls that apparently contained excessive amounts of lead paint. Lead is known to damage brain cells especially in children. In 2007, over 467 product recalls. An estimated 32 percent of all toys China exported contained lead. Toys like hotwheels even contained a deadly poison known as arsenic! The most likely reasoning for this is that heavy metals are much cheaper and using any other substance would likely push their costs up.

The awning went through the driver's windshield and struck him in the head, and he was killed. While investigating the crash, Mike discovered that despite the trailer owner securing the awning properly, the awning locking system was not strong enough to secure the awning and broke, allowing the awning to swing free. If you are not worried about doing quality control because you think you can send the defects back to China. Think again. Unfortunately, this is one the biggest headaches in China sourcing. The border control system in China is designed to make it very hard to get defective goods into China, even if the overseas buyer has clear paper trail and full support of the original supplier in China. For your reference, a Chinese friend of mine who worked at the port in the customs office told me that the Chinese government was concerned that if they allowed defective merchandise to be returned to China duty-free, some companies would take advantage by declaring legit imports defective to avoid paying the tax. So, as far as I know, there is no official channel for sending back the goods and avoid paying VAT and duties as they cross back into China. Adding insult to injury, the goods may be subject to China outbound taxes again when the re-shipment taxes place and perhaps inbound US duties/taxes will apply when the re-shipped goods arrive in USA. Did I just hear you scream in frustration? Don’t give up just yet, I have some ideas for you. Obviously, we should do our best to avoid quality problems by auditing our suppliers before we place the order and doing product inspections before the goods ship out and before final payment is made. Keep in mind that if you don’t have time to fly to China and do it yourself, Inspection Agents can conduct independent audits and inspections for only a few hundred US dollars, so there is no excuse for not checking the quality of your orders before the goods clear outbound China customs. Another good idea is to have clear terms in your contracts about how defective merchandise is to be handled. But despite the best intentions, defects may happen, What to do? Well, here are some tools. First step is to clearly define the following costs: • How much would it cost for the supplier to replace and ship the defects via a new shipment? • Do the defects that have already arrived have any value as scrap or “B” grade goods? • How much would it cost for you to fix the defect items (if even possible) in your home market? With those numbers on hand for reference, here are a range of options, hope one helps you. • Send the defects back, and they eat the cost to return, rework and replace. Be very careful that this supplier will be around to complete the transaction and that you have a lot of leverage and history together. I have seen more than a few suppliers simply pass on doing business with the client ever again rather than do what is right and replace the goods. • Rework the goods in your home market with local technicians. If you are on the East coast of the USA, know that there is a not-for-profit organization called Hill Top Industries that specializes in reworking defective product that has arrived in the USA from China. • Scrap the defects and get a credit on the next order. • If all else fails and your supplier isn’t stepping up to the plate to fix the problems or saying “they can’t afford to fix it”, know that I have had many suppliers “suddenly” come up with the cash once a lawsuit was pending. Keep in mind that in China you can sue for lost revenue. Since you probably were expecting to add a healthy margin when you sold the goods to your clients, this lost revenue is a big stick you can use as leverage over your supplier. First, report your injury to your employer. Second, get good medical attention right away. Third, try to document what caused your injury. And fourth, if you were injured by the fault of another person who is not a co-employee or your employer, then you may have what is called a "Third Party Claim" against the "at fault" person or business who caused these injuries. Then, call my office to find out if you should make two separate claims for your injuries. What I mean by this is that one claim is under Workers Compensation, and the other is against the at fault third party. Each of these separate claims have different processes and different recoveries that you may be entitled to. For example, under your workers compensation claim, they pay your medical bills but only two thirds of your salary.
