Here's a brief rundown: Copyright/trademarks legally prevent sellers from using other people's works on their products for profit. What is Trademark law? By Hesham Elrafei https://www.linkedin.com/in/heshamelrafei Trademarks are brand names or designs , which are applied to products and services. A trademark is a distinguished word, phrase , a symbol , a fragrance or a logo , or a combination of these elements. which is used in trade/business , to indicate the origin/source of the brand, in order to distinguish and identify the brand owner in the market. Trademark law protects the consumer, by preventing the public confusion , as to the origin or quality of a product. and it also reward the brand owner , by maintaining his business successful reputation in the market. Trademarks legally conflict with each other, if the use of one trademark causes public confusion as to the product being offered in the market ( likelihood of confusion ) The american law protects trademarks even if its not registered, which is also known as the Common Law Trademark Rights, in this case registration is not required to establish trademark rights, seeing that the first who use a trademark in commerce owns it. On the other hand, Most countries require registration of a trademark , as it provides legal certainty and reinforces the position of the right holder . therefore any subsequent users who cause confusion as to the product or its origin , will be forced to stop using the mark , and might be liable to pay the trademark owner damages. Lastly, Trademark is not absolute as its subject to various limits and defenses, such as abandonment, limitations on geographic area in which the mark is used , and fair use , which means that the more common and generic the word is , the less likely the trademark owner may be able to regulate it. This doctrine also protects "nominative" use of the trademark name, as is often done by competitors in marketing materials.

For legal advice, please contact a lawyer. Question 1: Will you get sued if you use product images from Aliexpress suppliers? The answer to this is almost certainly no. In China, the culture around copyright is very different to the western world. In China, the culture around copyright is that if something can be easily copied and can benefit others, then that is more important than protecting the rights of a single individual. It is a cultural difference. As a result, it’s very easy to get away with piracy in China, which is why pirated movies/music/games are sold freely on the streets. In fact, Chinese manufacturers copy each other all the time. Not only do they produce the same products, they steal images from each other. If you go to Aliexpress you will see that different manufacturers are producing the same items, and they are using the same images. As a result, it is extremely unlikely that any Aliexpress supplier would try to pursue you in court for any copyright issues. If they were going to sue anyone - it would be the manufacturers that are copying them - although due to the cultural differences, that is also extremely unlikely. If you’re still worried, you can contact the Aliexpress suppliers and ask them if they are OK with you reusing their images. Question 2: How Can I Avoid Being Sued for Copyright Images? They might not care in China if you copy images - but in the west, they sure do! Even if your website is not making any money, you can still be pursued legally and sued for using images without permission - so it’s very important that you don’t use copyrighted images on your website! A good place to find images you can use is with Google Images: 1) Go to Google Images 2) Click settings. 3) Click advanced search. 4) Type in what you’re searching for. 5) Scroll down to usage rights. Select “free to use, share or modify, even commercially.” 6) Click search. You’ll be surprised at how many images you’re allowed to use! So don’t get lazy and use images that are copyrighted. Use Google to find free images you’re allowed to use. Question 3: Can I Sell Aliexpress Products that are Trademarked? No - do NOT sell products that are trademarked. For example, in the video, Sarah compares two items - one that is a generic self-stir mug, and one that is a self-stir mug with Harry Potter imagery on it. Do NOT sell the Harry Potter mug, as it is illegal. If you sell products with trademarks, you aren’t just risking getting sued - you’re risking having legal action taken against you.

But, thanks to knock off products, you can enjoy the appearance of the brand name without paying the hefty price. Artists and engineers around the world have dedicated their lives to creating knock offs as a full time job. Some knock offs are so good, that you can’t tell the difference, which is pretty spectacular for those of us who are on a tight budget. But, sometimes there are knock offs that just need to knock it off. From toys to food, these knock offs are obviously not the brand that you’re trying to imitate, but instead, are hilariously off the marker in epic ways. Whenever a product is a huge hit, it is almost a guarantee that will be knocked off in just a few short days. There are companies that want to cash in on the success of others, but thanks to copyright infringement, the companies can’t completely copycat these successful products. Some of these knock offs are fantastic, and makes people completely content in purchasing off brands. With the economy the way that it is, people are trying to find a way to save a buck or two whenever they can. If the off brand starts to out-perform the original brand, then the companies have a problem. But sometimes, the worst knock offs can be so deceiving that you could accidentally grab the wrong brand off the shelf, and then be met with a god-awful taste or experience once you get home. This video contains some of the worst knock off products that have ever been invented. Sodas are some of the most commonly knocked off products, with grocery stores carrying their own versions of cola, lemon-lime soda, and root beer. Purses are another hot ticket item that are knocked off on a daily basis. It is fairly common knowledge that some of the best purses on the market are the most expensive, and what you carry around with you dictates your social status. This is why purses are knocked off so often in many different variations. People have made careers out of how to detect a knock off product. Then there are knock offs of popular food products, which is almost a guarantee that there will be some sort of disappointment because most major food corporations patent their recipes and flavors in order to protect their brand. So if you think you’re getting a real Goldfish cracker, be prepared to be disappointed. Finally, kids are some of the pickiest people on the planet, and when they want a specific toy, they will know exactly what to look for. But parents will often find that the toy their child wants is too expensive, so they will seek out a knock off version to save some money. Sometimes, if the toy is made right, the child can be fooled. Some of the knock offs on this list are the product of pure hilarity, and have been immortalized for all the wrong reasons. TRADEMARK INFRINGEMENT AND THE LIKELIHOOD OF CONFUSION TEST A claim for infringement of a trademark may be based upon a violation of Common Law rights, State trademark registration, or Federal trademark registration, and all three claims may co-exist at the same time. Trademark registration only reinforces your rights. Contrary to popular beliefÇ due to common law rights you need not own a trademark registration for trademark infringement to exist. The key inquiry in a matter of trademark infringement is whether an ordinary consumer is likely to be confused between the trademarks. If the trademarks are confusingly similarÇ the prior user should request that the subsequent user cease use of the trademark. This commonly occurs in the form of a Cease and Desist Notice. If the subsequent user refusesÇ trademark litigation may ensue. The standard for trademark infringement is ìlikelihood of confusion.î No trademark shall be refused unless it causes confusion, mistake or deceit with a previous existing mark. A mark is infringing if it is confusingly similar to an existing mark. It is about public perception ñ will the public be confused? Specifically, the use of a mark in connection with the sale of a good is infringing if it is likely of causing confusion in the consuming public as to the source of those goods or as to sponsorship or approval of the particular goods. The Courts weigh factors to measure the likelihood of confusion: (1) Strength of the mark; (2) Proximity of the goods; (3) Similarity of the marks; (4) Evidence of actual confusion; (5) Marketing channels used; (6) Type of goods and the degree of care likely to be exercised by the purchaser (also known as ìpurchaser sophisticationî); (7) Defendant's intent in selecting the mark; (8) Likelihood of expansion of the product lines; (9) Quality of Defendantís goods or services; and (10) Whether the Defendantís attempt to register the mark was bona fide and in good faith. Simply put, there are no hard and fast rules in determining whether a likelihood of confusion exists. To summarize, the Courts will look at: (1) The similarity of the trademarks; (2) The similarity of the goods or services; (3) The similarity of trade channels; (4) The number and nature of similar trademarks in use on similar goods; and (5) The extent of any actual confusion. The most important factors are often the first two. Marks are considered very similar if they are close enough in sound, appearance, or meaning. However, using the same mark on a completely unrelated product will not give rise to infringement because consumers are not likely to believe that the goods are being produced by the same business. However, famous marks such as Coca-Cola and Coach are registered in a broad range of classes, making them virtually impossible to use in a different channel of distribution.

At a fundamental level, Copyright protects your original creative works such as books, movies, songs, paintings, photographs, and web content. As the owner of a copyright, you can control how your work is reproduced, distributed and presented publicly, and you can sue infringers in court. An idea itself cannot be copyrighted. A work must be in a fixed, tangible form to be protected. Copyright registration provides legal evidence and public notice of ownership, and by allowing the copyright owner to bring suit in court if there’s any infringement. Authors, artists, and other creative professionals typically seek copyright protection. On the other hand, Trademark protects the names, symbols or slogans for products or services that you sell. In other words, a trademark lets the consumer tell the difference between one company's product or service from another's. Trademarks include brand names such as "Coca-Cola" and images such as Nike's famous "swoosh." As the owner of a trademark, you can sue for trademark infringement and prevent someone else from using your name, symbol, or slogan. A trademark registration can potentially have an unlimited term, but has be renewed every ten years. The owner can renew the trademark registration as long as the mark remains in continued use. What is Patent, Copyright & Trademark in Hindi | By Ishan A patent is a right granted to an inventor by the federal government that permits the inventor to exclude others from making, selling or using the invention for a period of time. The patent system is designed to encourage inventions that are unique and useful to society. Congress was given the power to grant patents in the Constitution, and federal statutes and rules govern patents. The U.S. Patent and Trademark Office (USPTO) grants patents for inventions that meet statutory criteria. The following provides a general overview of what a patent is. Patent Categories There are three different kinds of patents: utility patents, design patents and plant patents. 1.Utility Patents: The most common type of patent, these are granted to new machines, chemicals, and processes. 2.Design Patents: Granted to protect the unique appearance or design of manufactured objects, such as the surface ornamentation or overall design of the object. 3.Plant Patents: Granted for the invention and asexual reproduction of new and distinct plant varieties, including hybrids (asexual reproduction means the plant is reproduced by means other than from seeds, such as by grafting or rooting of cuttings). Copyright: Copyright is a form of intellectual property protection provided by the laws of the United States. Copyright protection is available for original works of authorship that are fixed in a tangible form, whether published or unpublished. The categories of works that can be protected by copyright laws include paintings, literary works, live performances, photographs, movies, and software. A Copyright Owner's Rights: The primary goal of copyright law is to protect the time, effort, and creativity of the work's creator. As such, the Copyright Act gives the copyright owner certain exclusive rights, including the right to: 1.Reproduce the work 2.Prepare "derivative works" (other works based on the original work) 3.Distribute copies of the work by sale, lease, or other transfer of ownership 4.Perform the work publicly 5.Display the work publicly The copyright owner also has the right to authorize other people to do any of the rights mentioned above. The copyright owner has the option and ability to transfer his or her exclusive rights -- or any subdivision of those rights -- to others as well. The Copyright Office does not have forms for these transfers, so a transfer of copyright is usually done through a contract. It is not legally required for a transfer to be recorded with the Copyright Office, but having a legal record of the transaction is often a good idea. What is a Trademark?: A Trademark generally refers to a “brand” or “logo”. Trademark registration can also be obtained for a business name, distinctive catch phrases, taglines or captions. Properly used and promoted, a Trademark may become the most valuable asset of a business. Trademarks such as Coca Cola, HP, Canon, Nike and Adidas serve as an indication of origin of the goods as well as an indication of quality. It is also essential to obtain trademark registration for the business name/trade name under the Trademarks Act. Registration of a company or business name under the Companies Act does not in itself give protection against others who might commence using identical or similar marks. Let Us Register Your Trademarks - http://youtu.be/3lANdiFpPKQ Trademarks vs. Product Itself As I explained in the previous videos of this series (and make sure you watch them first), the function of trademarks to distinguish products and services of one business from identical or similar products or services of another business. What this means is that trademarks are not designed to grant their owners monopoly over the products or services themselves. This means two things: you cannot claim the generic name for your product to be your trademark and you cannot "trademark" the functionality of your product. Indeed, if you sell wizmos, you can't stop others from also selling wizmos by claiming that "WIZMO" is your trademark. Remember, the function of a trademark is to allow you to help customers find your wizmos among wizmos offered by your competitors, not to allow you to corner the market for wizmos altogether. This is often referred to as using the trademark as an adjective, as opposed to as a noun. You should also make sure that your once original trademark does not become generic, in which case it will stop functioning as a trademark. This was the case or almost the case with Aspirin, Kleenex, Xerox, Thermos, Jacuzzi, Linoleum and several others. This is where you should be very careful about your marketing strategy. From the marketing perspective nothing can be better than millions of customers using your brand name as in "I need a kleenex" or "Let me google that for you". However, from the trademark law perspective, such use should be discouraged, because it may lead to the death of your trademark rights. Instead you should promote the use of "I need a Kleenex tissue" and "Let me use Google search engine for you". Of course, most small business owners would say that it is a great problem to have. But even though too much fame may not seem to be a problem at the early stages of your business, this should become a consideration as you grow your business into something that will have resalable assets. Similarly, if the shape of your product is driven by certain functionality, you are not allowed to claim this shape as your trademark, simply because this would give you the monopoly on the functionality (which Is a proper subject of patent protection, but not trademark protection). The most famous examples of when companies unsuccessfully tried to claim trademark protection over the functionality of their products in Canada was in connection with LEGO blocks and the shape of a 3-head electric razor. In both these situations, the court found that what the companies really were attempting to protect was a monopoly to make the product, not to distinguish their product from similar products of others.

Advocates IP Law Alliance initiated action for infringement of trademark in Bangladesh. Samsonite Corporation -vs- Moon Light Travels. The local Agent of Samsonite Corporation lodged a complaint against a trader who imported counterfeit 'SAMSONITE' product for marketing in Bangladesh. The Agent investigated markets through their own investigator and found counterfeit product in a famous market, Shahbagh Biponi Bitan. Accordingly the Agent informed the same to Rapid Action Battalion (RAB-3). The Commanding Officer of RAB-3 entrusted the operation to one of its team leaders, Assistant Superintendent of Police. The team leader investigated the place and found the allegation true. The RAB Team conducted raid on February 27, 2008 and arrested three persons with huge counterfeit 'SAMSONITE' product. They were prosecuted under the penal provisions. The infringers found no other alternative but to surrender with the local Agent and accordingly disclaimed entire seized items of 310 big suitcases in quantity in favour of the local agent and given adequate compensation including undertaking for not trading anymore with counterfeit 'SAMSONITE' product. I was in the Slammer for infringement of copyright laws , I was being held at knife point by a manly looking woman with crazy in her eyes! That's when I woke up! Sweat was running off me like a stuffed roasting pig. The crazy part is, I have been thinking about copyright laws a lot lately, I guess that's why I had the dream. You see I have been guilty of using pictures and images from Google with out being completely certain of the copyright laws, rules and infringement issues and the truth is this... It is a illegal to use images, music and any other media if you don't don't follow copyright laws and have the legal rights to do so. So, even if you've been searching Google Images for pics that aren't water marked and blatantly labelled with the owners tag, how do you know the ones that you are using weren't stolen and used illegally by the site that you saved it from. The infringement of copyright laws is a crime punishable by law!! One of the main reasons why I have chosen this way of adding images to my blog post, etc. is because quite often many of the Royalty FREE sites charge an arm and a leg for the rights to use just a few pics. But here's the bright side to this picture!! My buddy Angus McEwan shared a post on his blog yesterday that changed all that worry, huge money out of pocket expenses and nightmares! I’ve got a question from Bas Van Den Tie and they ask “I have just started my own YouTube channel and I activated monetization. Can I use someone’s song if I put the link to the song in the description? And am I allowed to use Download Intro with my channel name in it? Please, help out.” Now, as well as Bas Van Den Tie, King of Bricks 1000 has the same question, so, shout out to you guys for a great question. 1:12 The answer is it depends. If you’ve downloaded music from iTunes or somewhere else like that, then you can’t put the music on your videos legally. Just because you’ve bought it doesn’t mean you have any rights to it except to listen to it for your own personal use. It is not a good thing to put it on your videos as you can get a content strike. 1:30 Any music like this, that is made by an artist is content that is owned by someone else, and you don’t have rights to use it. Putting those tracks on your video may cause a content strike. There are areas where you can get away with using music like this and I’ll go into that in another video. 1:51 One of the safest things to do is actually to use the free Royalty Free Music that YouTube gives you and that’s under the Create tab on your YouTube dashboard. In there you can find hundreds of tracks that you can use for free on all of your videos and you don’t have to worry about anything. 2:10 Another great recourse which was given to us by the Gaming Maverick, so shout out to you, is No Copyrights Sounds. You can find them on YouTube at www.youtube.com/nocopyrightssounds. You’ll also, find them on Sound Cloud as well, where you can download their music. 2:26 With No Copyrights Sounds you can download the music, you can put it on your videos. All you need to do is put a link to the video on YouTube in the description on your YouTube video, as well as put some other information about that song in your description, as well. Full details are on their channel and on their site so you can go over and download some of their music and add that to your videos. 2:47 There you go, those are some great recourses where you’ll get some Royalty Free Music for your videos and you don’t have to worry about getting content strikes on your YouTube videos. The rule is, don’t add music to your videos that you bought on iTunes or anywhere like that because you don’t have the rights to use it. Use the recourses I give you in this video and you’ll have plenty of music to be able to stay out or trouble. The most common actions falling under the banner of unfair competition include: Matters pertaining to antitrust law, known in the European Union as competition law.
