Interpretation means the art of finding out the true sense of an enactment by giving the words of the enactment their natural and ordinary meaning. It is the process of ascertaining the true meaning of the words used in a statute Kind of interpretation Grammatical interpretation grammatical or strict interpretation means sense conveyed by the actual words Logical interpretation logical interpretation means look behind the actual word, used to assumed intention of the Legislature General rules of interpretation As a general rule the courts are bound by the literal words of a statue it is only in exceptional case of ambiguity, uncertainty or incomplete meaning of the Statue, that rule of liberal interpretation is to be applied. The Cardinal rule of the interpretation of an act of parliament is that they should be construed according to the literal meaning conveyed by them The court has framed certain general rules for accepting ascertaining the literal meaning of the words used in a statue. Some of these rules are as under 1 The golden rule of interpretation is that the word of the statues must be given their ordinary meaning that is to say so long as the meaning of the statue is clear certain and unambiguous judges should not apply their opinion to modify the meaning of the words used in statue 2 Yet another important rule of interpretation is that a statue must be read as a whole in order to give effect to the intention of the former of it. The court must look to the object which the whole statue seeks to achieve while interpreting any of the provisions of the act 3 It is not competent for any Court to proceed on the assumption that the legislature has made a mistake the court must precede on the footing that the legislature intended what is had said even if there is some defect in the phrases used by the Legislature the court cannot aid the legislature is defective 4 for the sure and true interpretation of all statues in general whether they are penal are beneficial ,restrictive or enlarging of the common law four things are to be discussed and considered i what was the common law before the making of the Act ii what was the Mischief and that affect for which the common law did not provide iii what remedy the Parliament has resolved and appointed to cure the wrong iv reason of the remedy I am the student of Law and this is my channel which is all about Law. It is the Cardinal principle of construction that every statue is prospective unless it is expressly or by necessary implication made to have retrospective operation. a new law ought to regulate what is is to follow and not the past 6 It is an important rule of interpretation that a General later law does not abrogate an earlier special law by implication. the rule is contained in the well-known maxim which means that where there are general words in a letter act capable of reasonable and sample application without extending them to subject specially dealt with by earlier legislation it cannot be construed that earlier and special legislation is indirectly repealed, altered or derogated merely by the force of those general words 7 the meaning of the word may be affected by it context. This is known as the rule of noscitur a socis which means that the meaning of a word be judged by the company it keeps. Thus sometime the word void used in a statue made so mean by voidable in the context of reference to that act. 8 it is the rule of interpretation that penal statutes must be constituted strictly in case there is any doubtful word or phrase in a penal statue it should be construed in favour of the accused. This does not empower the court to twist the meaning of the word which is clear and unambiguous for the sake of beneficial construction in the favour of accused I am the student of Law and this is my channel which is all about Law. The court can however remedy only the logical defects and not moral or ethical if the provision of law is against misconception of morality or ethical he cannot substitute what he thinks for what the law says because this would amount to exercise of legislative power Ejusdem generis rule The most important rule of interpretation is the Ejusdem generis rule which means that there in a previsions which have some particular of specific word the general words are to be given meaning similar to a particular if a law prohibits the import of arms gum powder or any other goods the word any other goods according to this rule shall be interpreted to mean not elephant. Only such good as a similar to those mentioned previously in specific term as like fuse wire etc. it is necessary to discuss the rule of Ejusdem generis in relation to the rule of grammatical interpretation according to the rule sweeping clause in a statue which says “all other article whatsoever may be interpreted to means only articles of same clause and species” affected by the statue. Term milk products includes curd, cream etc. but Ghee is not because ghee is not perishable in nature items produce by milk are perishable nature You must be kept in mind that the word which has wider meaning in the statue will be interpreted generally not specifically Mischief Rule It was totally different approach the rule was first initiated in Hyden s case when the intention of the Legislature cannot be determined by the language of a statue in question the court may consider the historical background underline the statue. The circumstances under which the bill was introduced and it became law. The act is to be interpreted in such a way as to suppress the mischief and advance remedy This rule for interpreting that was laid down in 16 century and requires judges to consider three things 1 What the law was before statue was passed 2 what is problem or mischief, the statue was trying to remedy 3 what remedy Parliament was trying to provide Purposive approach Historically the preferred approach in statutory interpretation was to look for a statue s literal meaning however in now a days the court have accepted that the literal approach is unsatisfactory instead the judges have been increasingly influenced by European approach to statuary interpretation which focus on giving effect to purpose of legislation. Common law is a third branch of law, in contrast to and on equal footing with statutes which are adopted through the legislative process, and regulations which are promulgated by the executive branch. A "common law system" is a legal system that gives great precedential weight to common law, so that consistent principles applied to similar facts yield similar outcomes. The body of past common law binds judges that make future decisions, just as any other law does, to ensure consistent treatment. In cases where the parties disagree on what the law is, a common law court looks to past precedential decisions of relevant courts. If a similar dispute has been resolved in the past, the court is usually bound to follow the reasoning used in the prior decision (this principle is known as stare decisis). If, however, the court finds that the current dispute is fundamentally distinct from all previous cases (called a "matter of first impression"), judges have the authority and duty to make law by creating precedent. Thereafter, the new decision becomes precedent, and will bind future courts. Stare decisis, the principle that cases should be decided according to consistent principled rules so that similar facts will yield similar results, lies at the heart of all common law systems. One third of the world's population live in common law jurisdictions or in systems mixed with civil law. Common law originated during the Middle Ages in England, and from there was propagated to the colonies of the British Empire, including India, the United States (both the federal system and 49 of its 50 states), Pakistan, Nigeria, Bangladesh, Canada (and all its provinces except Quebec), Malaysia, Ghana, Australia, Sri Lanka, Hong Kong, Singapore, Burma, Ireland, New Zealand, Papua New Guinea, Jamaica, Trinidad and Tobago, Cyprus, Barbados, South Africa, Zimbabwe, Cameroon, Namibia, Liberia, Sierra Leone, Botswana, Guyana, and Fiji.

When the proper court determines that a legislative act (a law) conflicts with the constitution, it finds that law unconstitutional and declares it void in whole or in part. This is called judicial review. The portion of the law declared void is considered struck down, or the entire statute is considered struck from the statute books. Depending on the type of legal system, a statute may be declared unconstitutional by any court, or only by special Constitutional courts with authority to rule on the validity of a statute. In some countries, the legislature may create any law for any purpose, and there is no provision for courts to declare a law unconstitutional. This can occur either because the country has no codified constitution that laws must conform to (e.g., the United Kingdom and New Zealand) or because the constitution is codified but no court has the authority to strike down laws on the basis of it (e.g., the Netherlands and Switzerland). In many jurisdictions the supreme court or constitutional court is the final legal arbiter that renders an opinion on whether a law or an action of a government official is constitutional. Most constitutions define the powers of government. Thus, national constitutions typically apply only to government actions. This means that only governments can violate the nation's constitution, but there are exceptions. A constitutional violation is thus somewhat different from the breaking of a normal law, both in terms of seriousness and punishment. Declaring a law unconstitutional does not result in the punishment of those who passed it down. The legal encyclopedia American Jurisprudence says the following in regard to constitutionality: The general rule is that an unconstitutional statute, though having the form and the name of law, is in reality no law, but is wholly void and ineffective for any purpose since unconstitutionality dates from the time of its enactment and not merely from the date of the decision so branding it; an unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed ... An unconstitutional law is void. (16 Am. Jur. 2d, Sec. 178) A law in violation of an existing statute can be described as unstatutable. An action that breaks any part of the constitution could range from minor to major. In the United Kingdom, this is more ambiguous because such breach covers those that violate principles, procedures or rights, making it difficult to establish what is unconstitutional from the constitutional. It is clearer in the case of the United States, which considers an act an infringement if it violates the spirit or the letter of the written constitution....
